We recently purchased a new home from a builder in Florida. After the closing we received a notice of dues from a Homeowners Association, which we never knew existed. The builder did not reveal this nor was it brought up at the closing. We would not have bought the house had we known we had to join a HOA. We filed a claim with the Title Co. which they declined. The HOA now threatenes to place a lien against the house which is "homesteaded" and owned along with my wife's mother. We have a undivided half interest as joint tenants with right of survivorship. Under these circumstances, can the HOA really place the threatened lien against our home? Thanks for your anticipated reply, we are seniors (one 88yrs.old) and this really has us very upset.
