I'm getting some reports from people claiming that they have used 15 U.S.C. 1692(i) 811 (A)(2) which is the jurisdictional section of FDCPA to help defeat demand for ARB and claiming that in the event NAF accepts the arbitration demand and continues with it they will be in violation of FDCPA because of jurisdictional mandates of FDCPA.

That just might be a viable argument. Whether it is or not (legally speaking) if it scares them into getting off your back then so much the better. All we can do is try different things and see what seems to work the best.
