I would tend to agree with Bill for the same reasons he mentioned, although I'm not an attorney either. You may have to ask a local attorney in your state to get it straight. You could try and locate one here: http://www.naca.net/ Just click on Find A Lawyer, then choose your state and finally under Area choose Debt-Medical Expenses.

Thanks for the info, I will follow up on it, but what about them calling and sending me her medical info? did the violate anything? and is it illegal to record them when they call your house without telling them? or is a written log good enough? thanks again for the quick help, Brian.

I'm not an attorney so I can't give you any legal intrepretations of what Ohio law says but most states have only two different ways that SOL in debt situations is applied. It is usually stated that written contracts have one SOL that is longer than are "open ended" contracts or debts.

The only thing I can point out is that medical or hospital type debts could be construed to be either open ended or contractual and I can't tell you which one would apply. The reason I can't is because when you go to a hospital you are normally required to sign a separate agreement each time you go.

When you go to a doctor's office you usually sign such a thing only once. If I were faced with the problem I think I would do all that I could to claim that it was an open ended contract because once the agreement is signed they can just keep on addind as the need arises. Contracts usually refere to large purchases such as vehicle purchases, real estate contracts and that kind of thing.

So, in my personal (non-professional) opinion, it must be an open ended contract because it is not dealing with the purchase of any real tangible property such as a vehicle, a piece of machinery, a vacuum cleaner or real estate.
