We recently purchased a new home from a builder in Florida. After the closing we received a notice of dues from a Homeowners Association, which we never knew existed. The builder did not reveal this nor was it brought up at the closing. We would not have bought the house had we known we had to join a HOA. We filed a claim with the Title Co. which they declined. The HOA now threatenes to place a lien against the house which is "homesteaded" and owned along with my wife's mother. We have a undivided half interest as joint tenants with right of survivorship. Under these circumstances, can the HOA really place the threatened lien against our home? Thanks for your anticipated reply, we are seniors (one 88yrs.old) and this really has us very upset.

I (&wife) were recently discharged from Ch7 and when I just received my credit reports (copies of all 3 from annualcreditreport.com and all 3 from a paid service) I noticed there were differences between the free reports and the paid for reports. Question 1) Do I need to correct the errors on the "paid" ones as well as the "free ones" (even though they are from the same bureaus?) Yes! The paid one will probably be much more relevant and that is the one you should work with. I'm also wondering whether or not you should complain about the differences to the FTC? Maybe they need to look into that.
Problem #2: The reason we declared Bankruptcy was due to a $ 9000. civil court judgement which we could not pay. On the credit reports it states (for other accounts listed on the bankruptcy "schedule" "Debt included in or discharged through Bankruptcy Ch7,) YET for the Judgement, it does not say ANYTHING. Question 2) Do I need to get this corrected to show that this was also discharged? Thanks all for your anticipated reply.
Both are public records and the only way to get rid of it is to attack it as a void judgment (or at least try to) and if you can get it vacated then it will have to come off. Since it was discharged in bankruptcy you might not be able to get that done. I really don't know about that because all I know about bankruptcy is that it really, really *****.

It could be that if you get it vacated that might also affect your bankruptcy somehow. I just don't know about that.

Best advice I can give others is never file bankruptcy and this new law set to go into effect ought to help people see that it is a real bummer.

Bill has been teaching me a lot about how to make a forum work and how to publicize it. He is also helping the guy over at the Chase Bank s u c k s forum (http://www.tinyurl.com/8wxqw)

Bill really seems to get the job done when it comes to helping people with all sorts of problems. But I did have to figure out how to get around his message filters by using tinyurl.com to mask the url or my links here would not work. I'm sure he really won't mind my doing that.

I hope those of you who are having or have had problems with cap1 will come over and post on my message forum too.

Does anyone know the answer to this one? Background info.: I was recently discharged from Ch7 but, the trustee still wants me to either pay $ 5000. within one year for a car that is registered to me in FL (but, has a lien on it and in which I have no equity) OR I need to turn over the car immediately per court orders. Question: Rather than me giving up a car which does not belong to me (my mother loaned me the 5G to buy it, for her use, she's 88 & I'm the chauffeur) can I tell the court I want to CANCEL the bankruptcy (even though it has been finalized) . After all, had I known they were going to take the car at the getgo, I would not have filed. I thought the car was "safe" because of the lien and since I had no equity in it.
I don't know anything about BK to start off with but it seems to me that you should have registered the car in your mother's name instead of your name. Of course, hindsight don't help you now.

I'd say you need to talk to your bk attorney about this and maybe also the lender and tell them what is going on so they can step in if possible. Seems to me they would have something to say about all of this, and especially so if it might mean that you would have to file bk on them too.
