The woman sounded worried. She'd been trying to get in touch with my neighbor for some time now and hadn't been able to get through.

Would I mind contacting that neighbor and giving her the caller's telephone number?

My initial reaction was to be helpful, especially since the woman was calling from Buffalo, N.Y.

But then I began feeling that something wasn't right, especially since that return telephone number included a seven digit reference number.

It was probably a call from a collection agency.

According to the Bureau of Consumer Affairs in Harrisburg,Pa the call I received Friday morning may or may not have been illegal, but either way the bureau will provide a complaint form for those who receive such calls.

Calling neighbors to track down debtors is one of the latest tactics used by some collection agencies.

"More credit and debt collection companies are using illegal, aggressive tactics," said Barbara Petito, deputy press secretary for the state attorney general office. While contacting a third party is not prohibited, contacting a debtor at work is illegal.

The majority of debt collection agencies are following the law, but there are some that Petito refers to as "rogue agencies" using deceptive business practices. For example, she said they may try to create a false sense or urgency or an emergency just so the person makes contact.

In this case, "Mary Jo" made it sound as though her repeated telephone calls had gone unanswered. She never crossed the line in calling it an emergency. And, she clearly stated she was not making a telemarketing call.

Petito's office has received an increasing number of complaints about collection agencies, but she noted it could be related to the higher numbers of people deeply in debt. There are many who have overextended credit card debt, sometimes due to a medical emergency, a lost job, divorce or death in the family.

"As consumers become more aware of their rights, they are aware that some of the treatments they're receiving are illegal," she gave as another reason for the increasing number of complaints.

In brief,collection agencies cannot:

• Contact you at unusual times or places

• Contact you before 8 a.m. or after 9 p.m.

• Contact you at work

• Contact you when the debt collector is aware you are represented by an attorney.

They may contact third parties to ascertain your location; however, they may not reveal to third parties that you owe a debt.

Debt collectors may not harass you or third parties in connection with collecting debt. They are prohibited from using threats of violence, obscene language or repeated telephone calls.

The Attorney General's office in your state can be of great help but you must also be aware that they are only empowered to act in cases where the interests of the state are in question for the most part.

What you really need to do is to learn what your rights are under the law and learn how to use them against the debt collectors who break the law.

From what I have read sounds like you need to become a wrench student..Also looks like they have many violations of the DCPA against them. You need to learn how to apply those violations so that they come out the losers and not you..

I've been trading letters with Continental Central Credit Inc. out in California and I'm finally po'd enough to just say see ya in court. Any opinions on the process from here will be greatly appreciated! Our story so far:
5/1/05 Paid an annual maintenance fee late. It was late and I paid in full principle plus all late fees and interest on the 04/05 statement the OC sent me.
05/29/05 Received 1st letter from CCC dated 5/25. Stated they rec'd payment and disputed my "attempt to fully discharge the above referrenced debt". They are demanding interest and collection fees. Included copy of CA civil code Sec 1526(A). With mini miranda.
6/2/05 I sent DV CMRRR to the CA. They rec'd on 6/6/05.
6/9/05 Rec'd another collection letter from CA dated 6/6/05. Basically, we have been assigned this debt by OC so pay it. If you ignore this notice we might sue and get all these extra fees. With MM. Lists Principle $0, Int $x.xx, Court cost $0, Atty fees $0,Coll fees $xxx.xx, Total $xxx.xx. Is this validation?
7/22/05 Rec'd another collection notice from CA dated 7/18/05. No letter, just a card in an envelope. Same $$ breakdown as before with MM.
7/25/05 Sent letter disputing again and saying they have not validated the debt (included copy of my prev. letter and RR) CMRRR. The Rec'd 7/28/05.
8/6/05 Rec'd another notice dated 8/2/05. 5 DAY FINAL NOTICEYour silence will compel us to follow clients instructions.CONTACT US IMMEDIATELY. With MM same $$ breakdown.

I have also been in contact with the OC by letter, faxes, and phone. They refuse to send me a statement and say I must go through the CA to get any info. After I pay the CA and bring my account "current" the OC says they might send a statement.

Sorry to be long winded. What would the learned members suggest next?

Before the days of modern computer wizardry, there was a little piece of paper most people generally would keep in their wallet or pocketbook commonly known as the check. I now digress….

In earlier years, you have always heard stories of your parents or their parents in communities or neighbourhoods that routinely paid their tab on a weekly basis at local grocery stores, hardware stores, pharmacy’s, general supply stores and so on. Those days are over.

“In the good old days” local merchants would most likely understand if in hard times you were a “day late and a dollar short”. Just to have your business, store owners would bend over backwards to please “you” the customer. Lost to antiquity.

Times have changed, and so has the way we do business. Credit card companies will extend credit to virtually anyone, regardless of household income, no credit, low credit score or bankruptcy. It simply does not matter, as long as they can get their hands into your pockets, and once they do, they never take them out. I now regress...

Like most computer age savvy people, we are jubilant over the fact we can pay all of our bills on time with just a few clicks of our mouse. The only problem is, the credit card lenders that once waited literally days for a personal check to clear by conventional means, demand nearly impossible deadlines to receive their payment.

Here is how Chase Visa extorted thousands out of my pocket. With a low APR, I consolidated my entire credit card debt load to my “Bank One” card. Bank One was then purchased by Chase. I was seventeen years without a delinquent payment to Bank One the original lender. One month and “ONE” late payment later, I was hit with a $35.00 late fee and a ridiculous APR hike of 9.9%, to increase my now "new" APR with Chase to 26.9%. This is insane!

In my humble opinion, Chase Bank, is in violation of the RICO act should be investigated by the Federal Government for racketeering. I paid Chase Bank the old fashion way, I wrote them a check for $20,058.26 and closed forever my dealings with Chase Bank, and recommend everyone else do the same.
