I would suggest that you read through some of the post in the arbitration forum. There are some good discussions there. Maybe you can pick up something that will give you some ideas. I recently received an arbitration claim form Mann Bracken and responded with a letter rejecting arbitration and stating that I never agreed to arbitrate. Unless you always read the fine print I am sure you weren't aware of the arbitration clause, if in fact one exsisted. Make them prove that they had an agreement to arbitrate. Have you ever asked for validation of the debt? After I sent my reply to NAF and Mann Bracken they requested a stay of the arbitration. The letter I wrote is in the student lounge if you are a student. If you are not a student send me a private message and I will give you a copy of the letter. Each case is different so it may not work the same way for you. But you may be able to get some ideas. Also read the arbitration rules you may be able to pick something up from there. In the end if they win a judgement they will be able to seize your bank account. Even if the source of money is exempt form garnishment they will do it anyway just because they can. I went to a similiar situation earlier this year and it took 2 months for me to free my account. So if they win a judgement I would take the money out of the bank.

Here's the deal...I recently pulled my credit to see all of my accounts and such and to check on things. Well, there were 3 collection accounts which I have never seen. I called one place, and got it taken care of. They are going to completly delete it off of my credit report and I have documentation of that. Another place I called said that they would have no problem deleting it off of my credit to the original creditor asked them to do so. So I talked to them...and they said they made payment arrangements with my mother and admitted to never talking to me. Can I do anything about this? I have to call their collections department within the facility to talk with them...what should I say? And, I think the last one will be much of the same.

Sounds to me like you need to deal with the original creditors and that is what you seem to indicate that you are doing. It also seems that you are saying that these were never your debts in the first place but rather they belonged to your mother. If they continue to try to hang your mother's debts on you then you may have to sue them to get them off.

1) During 2001 and 2002 i had a few bad checks that i had written. And recently i graduated from college and ready to pay them off. Is there a way to increase my credit score by paying them off or do i need to something special so that they can delete the negative items and increase my score. As a normal rule, paying them off isn't going to increase your credit score by enough to make any difference unless the amounts are very large. The older the reports get the less impact they will have on your score anyway.

Yes, they do have the right to charge interest even after charge off. There probably isn't any "best possible" way to deal with any creditor once it has gone into charge off unless you can reach an agreement with them to pay in full in return for the re-instatement of your credit privileges.
That can be done sometimes but probably not with Cap One. You never know until you try.

If Cap One won't work with you in return for payment in full then the next best possible way is to wait until it goes to collections (depending on what state you live in) and then deal with the collector using creditwrench methods. The chances are at least reasonably good that you may be able to get by without a lawsuit at all or that in the event you do get sued it will happen so far into the future that the statute of limitations will run out on them and you can use a SOL defense which will win every time.

Those are about the best answers I can give you at this time and given the amount of information you have supplied.

Depending on what state you are in there are some stringint consumer laws on repos. You need to check them out through your state consumer site. Florida laws are very tough on this.
Things such as where and when the car was sold who the car was sold to and for how much. You see generally they wholesale your car and then hit you with all costs plus the differance you owed on the car sooo you need to contact FMCC with a demand for this info and they need to provide it to you if not they maybe in violation of your state laws also you need to check the fair market value of the car when it was sold and see if they got that amout for it if not you may have cause for action,, as far as the CRA goes you can try but do not be suprised if the answer comes back as cofirmend.
